Safety
Policy
Under the
Health and Safety at Work Act 1974, Section 2, employers who employ five
or more employees, MUST have a Health and Safety Policy, be brought to
the attention of all employees and be revised as is necessary.
The Policy
is also a useful document for informing employees and other persons of
your Health and Safety arrangements, such as sub-contractors or during
tendering and securing contracts.
So even if you have fewer than five employees and don't have one, it's
still good practice to have a Policy.
Competent
Persons
All employers,
no matter how large or small, have a legal duty to gain advice and assistance
from competent persons to assist them to meet the legal requirements.
This is a requirement under regulation 7 of the Management of Health and
Safety at Work Regulations 1999, (MHASW).
Employers who are large organisations will generally employ their own
Health and Safety professional, normally titled a Health and Safety Advisor
or Officer and they should hold formal recognised qualifications, ie IOSH/NEBOSH
standards and also have appropriate experience.
For the smaller company, it may not be possible or be required to directly
have such a person(s) on the regular payroll and this is where many turn
to Health and Safety consultants/companies to assist them fulfil this
role.
But whatever the size of the company, this duty under MHASW regarding
competent persons applies, so do not be caught out !
